The European Commission has imposed two separate duties - a final anti-dumping duty and a final countervailing duty - on imports of some organically coated steel products from China after an expiration date check, Kallanish notes.
AD (Regulation 2025/1508) and countervailing measures (Regulation 2025/1506) apply to flat rolled products made of non-alloy or alloy steel, with the exception of stainless steel, which are painted, varnished or coated with plastic on at least one side. They exclude sandwich panels used in construction, products with a final coating of zinc dust (containing 70% or more zinc by weight), as well as products with metal coatings of chromium or tin.
New Chinese exporters who did not export during the initial investigation period (October 2010 - September 2011) are not related to the duty-affected exporters and may indicate current or upcoming exports, can be added at the weighted average anti-dumping duty rate of 13.6% applied to cooperating companies that have not been sampled
The AD Regulation stipulates that in the event of a change or cancellation of countervailing duties in accordance with a separate regulation, the anti-dumping duties will be adjusted proportionally, taking into account the limits of the dumping margin or damage established for each company.
The Compensation Regulation allows for future upward adjustment of these duties if parallel anti-dumping duties are changed or abolished to ensure that the coverage of cumulative duties does not lead to a drop below the level of injury or dumping margin. In cases where the countervailing duty has been deducted from the anti-dumping duty, the refund requirements will result in a reassessment of the applicable dumping margin.
